Although the road to recovery for those injured by denture cream over exposure is a long for some, it has to be done within a certain time frame due to current statute of limitation laws that are in place. These current laws directly affect those who are willing to file a Fixodent Settlement Lawsuit.
The next question one would ask is what exactly is statute of limitations? The statute of limitations is a law that sets the amount of time a person has to take legal action following an incident that gave rise to a claim for damages. So this means that any claim filed beyond the described amount of time will not be deemed valid in the eyes of the law. The usual amount of time is about one year; however this will vary from state to state.
So why put a limit on the amount of time you have to file a complaint? This is done because the longer you wait to file it will be difficult to guarantee that the evidence, witnesses, and testimony you provide reflect what really happened. Peoples’ memories fade over time, evidence is lost and corrupted, and most of the time its just difficult to prove how something went down as time goes by.
However all injury claims resulting from the use of a dangerous of defective product must strictly adhere to the statue of limitations. In most cases, the statute of limitations begins to run at the time you are injured and expires from one to three years later depending on where you live.
There are times where the time your injury starts is not clear. This is why several states follow a “discovery” rule. This “discovery” rule states that the statute of limitations would begin to run at the time an injury is discovered or reasonably should have been discovered.
There is only a limited time to file your potential Fixodent Settlement Lawsuit, and if you are not careful the court may deem that the statute of limitations has expired.
