New warnings about the femur fracture risks of Fosamax have been required by the Food and Drug Administration (FDA) to be put on the drug’s label. Following a consistent stream of lawsuits flooding different courts, a multidistrict litigation (MDL) was formed to facilitate hearing and judgment. Currently, Fosamax lawsuit settlement negotiations are tasked on a law professor.
As more Fosamax complaints poured in, the New York District Court decided to establish a MDL that willassume jurisdiction on all Fosamax-related problems. The creation of this MDL happened around 2006 and now it is attending to around 900 cases.
The main goal of a MDL is to facilitate out-of-court settlement on those cases while making sure those common legal issues on each individual lawsuit will be resolved. The task that comes with MDL is always hard considering when disagreement happens, there is need to handle a lot of individuals. This challenging task now falls under the hands of John D. Feerick, a former Fordham law school dean. On November 22, 2011, he was appointed by New York Federal Judge John Keenan. Things became interesting when both the plaintiff’s steering committee and Merck did not disagree over this appointment. As a lawyer, Feerick has 21 years of private practice experience. He has been chairman of the board directors of many different, top-rate, trusted law-related organizations.
Four Fosamax lawsuits have already been in a bellwether trial which can be an assessment of how future Fosamax cases will turn out. Merck won three out of the four trial which can seem pretty depressing for a plaintiff. In the coming year, two more bellwether trials are scheduled. Can these future trials present a good result for people experiencing osteonecrosis of the jaw or a Fosamax femur fracture? We will just have to find out.
