Since the United States Food and Drug Administration (FDA) recalled the drug propoxyphene, the main ingredient in Darvon and Darvocet, last November 2010, the number of Darvon Lawsuits filed has grown exponentially in number. What is unknown to most is that even though the main ingredient of Darvon and Darvocet is propoxyphene; the drugs also contain acetaminophen, otherwise known as its common name Tylenol. Armed with this information the question is raised if those injured can sue an acetaminophen manufacturer with a Darvon Lawsuit as well.
The answer to that question is no, even though acetaminophen is dangerous and is known to cause liver damage, there aren’t enough grounds to constitute a Darvon Lawsuit. A lawsuit cannot be filed right away just because a drug is dangerous as well, there are several factors that lead to that. The FDA, who determines if the drug will receive a permit for distribution; always measures the drugs risks versus its benefits, meaning as long as the drug benefits outweighs its risks a potentially dangerous drug can get FDA approval.
Even if the drug gets FDA approval the drug companies must warn their consumers of the products side effects. Although the FDA ordered revised product labeling of all propoxyphene products in 2009, this action fails to take into account the many Darvon and Darvocet users who were harmed by the drugs before then. The chief complaint that those who have filed cases against Xanodyne, the main distributor of Darvon and Darvocet, is that propoxyphene can disrupt the heart’s normal rhythm, potentially causing a heart attack, stroke, or other cardiac complication as shown by the study done by Xanodyne. The FDA quickly called for the ban of the drug after reviewing the results of the study.
There are some lawyers who feel that the cases against Xanodyne and other distributors of propoxyphene are to eventually number in the thousands and claims will cost these companies billions of dollars. If this comes to true it could make the Darvon Lawsuits one of the biggest pharmaceutical settlements in history.
